Acceptance
By creating an account you accept these terms.
If you do not agree with any of these terms, you should not create an account or use the service. We may update these terms when necessary; if the change is significant we will notify you by email or through a notice on the website before it takes effect, and continued use of the service after that date will imply acceptance of the updated version.
Description of the service
Choose Your Own Adventure is a platform of interactive stories in Spanish and five other languages. One user acts as the host: they create a game from a story in the catalog and share a code so that other people can join with a nickname. During the game, decisions are made collectively through votes with a 30-second window, and each game supports up to 200 players.
The service is provided exclusively through the responsive website, accessible from the browser of any device (computer, tablet, or phone). We do not offer or promise native apps on the App Store, Google Play, or any other store; any app claiming to be official that is not accessed from our web domain does not come from us. Part of the catalog is free and part requires premium access or the individual purchase of the story.
Account
You are responsible for keeping your credentials confidential.
You must be over 18 to create an account and use the service. By signing up you declare that you meet this age requirement. It is not aimed at minors, and if we detect an account belonging to a person under 18 we will close it. You are responsible for all activity carried out from your account and must provide truthful and up-to-date information.
Payments
We offer two payment options: a premium subscription of €9.99 per month, which gives access to the entire premium catalog while it is active, and a one-time payment of €3.99 per story, which unlocks that story permanently. Prices are expressed in euros; the final amount, including applicable taxes, is always shown during checkout before you confirm the purchase. After each charge you will receive the confirmation and receipt by email.
The only accepted payment method is the Stripe gateway; we do not accept PayPal, bank transfer, or other methods, and there is no free trial period or annual plan. The subscription renews automatically each month, charging the current amount to your payment method, until you cancel it. You can cancel at any time from "My account": cancellation stops future charges, but you keep premium access until the end of the period already paid for. The one-time payment per story does not renew. Your card details are collected directly by Stripe in a secure form and never pass through our servers.
No refunds are issued. Since this is digital content available immediately, once payment is completed and access is enabled you will not be entitled to a refund of the amount paid, neither for the subscription nor for the one-time payment per story, except in cases where mandatory consumer protection regulations require it. Before paying you must expressly accept the waiver of the right of withdrawal described in the following section.
If a renewal charge fails, Stripe will retry the payment over the following days and we will notify you by email so you can update your payment method. If the charge ultimately cannot be completed, the subscription is cancelled and you lose premium access; any stories you purchased with a one-time payment are not affected and you keep access to them.
Waiver of the right of withdrawal
The service consists of the supply of digital content not provided on a tangible medium (interactive stories and access to premium features) whose performance begins immediately after purchase. In accordance with Article 16(m) of Directive 2011/83/EU and Article 103(m) of the consolidated text of the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007), the 14-day right of withdrawal does not apply when the consumer has expressly requested and consented to immediate performance and has acknowledged that, upon receiving access, they lose that right.
Therefore, by ticking the consent box during the payment process, you expressly declare and accept the following: "I expressly request and consent that the supply of the digital content begin immediately, before the 14-day withdrawal period ends, and I acknowledge that, once I have been given access to the content, I lose my right of withdrawal." This consent is mandatory in order to complete the purchase and obtain access to premium content.
This waiver applies both to the monthly subscription and to the one-time payment per story. Once access has been provided and your express consent given, you will not be able to withdraw or claim a refund of the amount already charged, without prejudice to your rights in the event of defective or non-conforming content. We keep a record of this consent along with the date and time you gave it.
Content and intellectual property
All the stories, illustrations, and texts in the service are protected by copyright. You may play, share your final progress on social media, and link to the site. You may not copy the stories, redistribute them, or use them to create derivative works without written permission.
You retain ownership of any content you contribute (for example, your nickname or your gameplay decisions). By using social features or sharing your progress, you grant us a limited license to display that content within the service for the purpose of providing it. We acquire no intellectual property rights over the stories beyond those that already belong to us or have been licensed to us by their authors.
Changes to the service and the catalog
We may update stories (corrections, improvements, or new versions), add new stories, and remove others from the catalog. The premium subscription gives access to the premium catalog as available at any given time, without guaranteeing that any specific story will remain in the catalog.
If you purchased a story with a one-time payment you will keep access to it, even if a new version is published, unless we are required to remove it for legal reasons or due to third-party rights. We may also modify platform features as long as what you have already contracted is not substantially altered; significant changes will be announced with reasonable notice.
Prohibited conduct
To keep the service safe and available for everyone, by using it you undertake not to engage in any of the following conduct:
- ·Accessing premium content without having paid for it, sharing credentials, or circumventing access and payment controls.
- ·Copying, bulk-downloading, redistributing, or creating derivative works from the stories, illustrations, or texts without written authorization.
- ·Using bots, scrapers, or automated means to access the service, as well as attempting to bypass usage limits or security measures.
- ·Interfering with other people's games, impersonating others, using offensive nicknames, or spreading illegal, abusive, harassing content or content that violates the rights of third parties.
- ·Attacking, overloading, or attempting to breach the security of the infrastructure, or using the service for fraudulent purposes or purposes contrary to the law.
Liability
The service is provided as is. We are not liable for indirect damages.
To the fullest extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data, or service interruptions. We do not guarantee uninterrupted availability and may carry out maintenance work. Nothing in these terms limits liability that cannot legally be excluded, including the mandatory rights granted to you by consumer regulations.
Termination
You can delete your account at any time from the "My account" section. We may suspend or close accounts that breach these terms. Personal data is anonymized immediately when the account is deleted — anonymous progress (aggregated decision statistics) is retained.
If you close your account, or we close it for breach of these terms, you will lose access to premium content and to games in progress. Deleting the account does not entitle you to a refund of amounts already paid, in accordance with the payment policy and the waiver of the right of withdrawal described above.
Complaints and dispute resolution
If you have any problem with the service or with a charge, write to support first: most issues are resolved that way. We will handle your complaint and reply within one month at most.
If you act as a consumer and are not satisfied with our response, you may turn to the public consumer services of your region and to the accredited alternative consumer dispute resolution bodies (Spanish Law 7/2017). We are not generally adhered to any consumer arbitration scheme, without prejudice to the mechanisms the law requires of us. In any case, you always keep the right to bring proceedings before the courts of your place of residence.
Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute will be submitted to the competent courts in Spain, without prejudice to consumer rights under EU regulations.
